DECISION AND ORDER

RICHARD L. SPEER, Chief Judge.

This cause comes before the Court after a Trial on the Plaintiffs Complaint to Determine the Dischargeability of a marital debt. At the Trial it was established that the debt at issue in this proceeding arose under the following circumstances:

The Plaintiff and the Defendant are former husband and wife, and during the Parties’ marriage to one another, the Plaintiff owned and the Defendant operated a business by the name of Lew Miller Excavating.
