TAPLEY, Justice.

On appeal. The appellant was indicted for the crime of manslaughter. The case was tried before a jury in the Superior Court, within and for the County of York. The jury returned a verdict of “guilty of assault.” Following the rendition of the verdict the presiding Justice found, on the basis of the evidence produced at the trial, that th"e assault was of a high and aggravated nature.
