While traversing Hamilton street at its intersection with Montgomery street, in the city of Spokane, a pedestrian was struck by an automobile operated by Alfred E. Beitlich in the service of the Western Union Telegraph Company. The pedestrian instituted this action to recover from the employee and the employer for personal injuries sustained as a result of that accident. Defendants denied negligence on their part and pleaded in bar of the action contributory negligence of the plaintiff- as the proximate cause of the accident.
