This ease is before the Court upon the appeal of the September 14, 2016, order denying the Petitioner Patrick Shawn Collins’s motion for sentence reconsideration filed pursuant to West Virginia Rule of Criminal Procedure 36(b) (also referred to as “Rule 35(b) or “Rule 35(b) motion”).
