I. INTRODUCTION

This case involved a challenge by certain Alaskan Native Tribes (“Tribes”) to a regulation promulgated by the Secretary of the Interior (“Secretary”) regarding taking land into trust on behalf of all Indian Tribes,'25 C.F.R. § 151.1, pursuant to section 5 of the Indian Reorganization Act, 25 U.S.C. § 465.
