This is an appeal by the sole beneficiary named in the will of Mrs. Bertha Schubert Witt, also known as Mrs. Bertha Carlson, from the judgment rendered by the court below in favor of the contestant, and from the order denying a new trial.

Bertha Schubert Witt, also known as Bertha Carlson, died on the sixth day of February, 1923, in the county of Los Angeles. She was at the time of her death about sixty-two years of age and had been a resident of Los Angeles for some twenty-eight years.
