CROSS, Presiding Judge.

In this action plaintiff sues to recover damages for personal injuries sustained when she allegedly fell down in defendant corporation’s store located in Independence, Missouri. The case was tried to the court without a jury on plaintiff’s pleaded theory that she was caused to trip and fall as a result of defendant’s negligence in maintaining a floor mat on its store premises in a dangerous and unsafe condition. At the conclusion of plaintiff’s evidence, defendant filed a motion for judgment which the trial court denied. Defendant declined to go forward with any…
