Appellant Juan Xavier Hurel Guerrero (“Hurel-Guerrero”) was convicted in the United States District Court for the Eastern District of New York (David G. Trager, Judge), upon a guilty plea, of conspiracy to possess cocaine with the intent to distribute under 21 U.S.C. § 841(a)(1). On February 10, 1995, after a Fatico hearing, see United States v. Fatico, 579 F.2d 707 (2d Cir.1978), he was sentenced in accordance with the United States Sentencing Commission Guidelines Manual (“the Guidelines”) to a term of imprisonment of 151 months (which was the minimum…
