MEMORANDUM OF DECISION AND ORDER

SPATT, District Judge.

Sheron Thomas petitions this Court pursuant to 28 U.S.C. § 2254 for a writ of habeas corpus. The Petitioner seeks ha-beas corpus relief from her December 17, 1997 conviction, following a trial by jury in Supreme Court, Suffolk County, New York, for one count of depraved indifference Murder in the Second Degree. N.Y. Penal Law § 125.25(2) (McKinney’s 1995). After conviction, the Petitioner was sentenced on January 14, 1998 to an indeterminate term of 25 years to life.
