Respondent, The Balloon Plantation, Inc., brought this action against appellants Head Balloons, Inc., and Tarp Head, alleging a breach of contract, fraud, breach of contract with fraudulent intent, and a violation of the Unfair Trade Practices Act. Head Balloons and Mr. Head answered and counterclaimed, alleging a breach of contract. The Balloon Plantation moved for an order to compel discovery.
