MEMORANDUM OPINION AND ORDER

Defendants, the Port Authority of New York and New Jersey (“PA”), PA Sergeant Gravano, and PA Officer Robert Sznurkowski (collectively, the “PA defendants”), have moved for summary judgment pursuant to Federal Rule of Civil Procedure 56 seeking to dismiss the claims alleged against them by plaintiffs Daniel Pelayo and Kristina Kauts. The events giving rise to this lawsuit took place in the early morning hours of June 3, 2009 when Kauts and Pelayo were detained at the John F. Kennedy Airport (“JFK”).
