State v. Thomas

{¶ 1} Defendant Richard Thomas is charged with operating a motor vehicle under the influence of alcohol in violation of R.C. 4511.19(A)(1)(a) (the “general” charge) and 4511.19(A)(1)(b) (the “prohibited-concentration” charge). The relevant facts are stipulated by the parties as follows.

{¶ 2} On June 24, 2009, defendant was stopped for failing to maintain control of his vehicle on County Road 59. As a result of the stop, defendant was arrested on the charge of operating a motor vehicle while under the influence of alcohol in violation of R.C. 4511.19(A)(1)(a) (general…
