Statement of Proceedings
This adversary proceeding came on for bench trial on December 6, 1989 pursuant to pretrial order of the Court on October 26, 1989.
The Plaintiffs complaint alleges that a certain indebtedness to it by the Defendant arising out of an “NSF” check dated June 30, 1988 in the sum of $3,459.28 is nondis-chargeable pursuant to § 523(a)(2)(A) in that the Defendant fraudulently obtained possession of a certain motor vehicle from the Plaintiff by fraudulently tendering to the Plaintiff said check in…
