Appeal by the defendant from a judgment of the Supreme Court, Queens County (Naro, J.), dated March 20, 1989, convicting him of robbery in the first degree, tampering with a witness in the third degree, and resisting arrest, upon a jury verdict, and imposing sentence.

Ordered that the judgment is modified, on the law, by reversing the conviction for tampering with a witness in the third degree, vacating the sentence imposed thereon, and dismissing that count of the indictment; as so modified, the judgment is affirmed.
