Defendant appeals from an adverse judgment, and from an order denying its motion for a new trial.

The suit was upon a policy of fire insurance. On February 19, 1907, defendant issued the policy insuring plaintiff's property for one year in the sum of two thousand dollars. The premium, which was paid, was $120. Shortly after the issuance of the policy defendant, being dissatisfied with the rate charged, demanded an additional payment of $20.
