1Per curiam
The essential factual background which resulted in this appeal is uninvolved. Between January 1-February 23, I960, the defendant in error, referred to as Halliburton, or plaintiff, furnished services and materials to J. E. Epperson, d/b/a Epper-son Tank' Trucks, hereafter the defendant, then engaged in drilling an oil and gas well in Caddo County, Oklahoma. The well failed as a producer and was abandoned. On July 16, 1960, the drilling company (Signet Drilling Company) sued defendant and numerous other creditors in Caddo County for money judgment and foreclosure of lien upon the leasehold.…
