The questions presented in argument are: 1. Whether there was sufficient evidence to go to the jury upon the defendants’ claim of fraud in the procurement of the lease and notes sued upon. 2. .If so, whether plaintiff’s claim to being a holder in due course of the notes had such support in the record as to require the direction of the verdict. Plaintiff claims, thirdly, that there is no competent testimony tending to show that the rental value was less than defendants agreed to pay, upon which an award of damages might be made.
