This is Albert R. Jensen's appeal from a circuit court order affirming a municipal court order vacating an operating while intoxicated forfeiture judgment. After a motion from the city attorney, the municipal court vacated its judgment against Jensen on grounds that it lacked subject matter jurisdiction. This is because, unbeknownst to the municipal court at the time of entering judgment, Jensen's offense was a second offense making it a crime, not a forfeiture.
