This action was commenced in the District Court of Carbon County by the plaintiff against the defendants for an injunction to restrain the defendants from going upon and constructing .an irrigating ditch over and across plaintiff’s land. In a supplemental answer filed by defendants they alleged that appraisers had been duly appointed by the County Commissioners of said county to view the premises and assess plaintiff’s damages for. the construction. of said ditch, and that said appraisers had viewed the premises and had made due report and return of their ascertainment and…
