The instant appeal arises from the District Court’s resolution of cross-motions for summary judgment addressing First Amendment retaliatory prosecution. Appellant Anthony Favata (“Appellant” or “Favata”) brought suit against Appellee Kevin Seidel (“Appellee” or “Seidel”), a trooper with the Pennsylvania State Police, after the latter cited Appellant for disorderly conduct in the wake of an altercation that occurred on a highway exit ramp.
