The plaintiff in error, hereinafter called defendant, was convicted in the district court of Noble county of manslaughter in the second degree, and his punishment fixed at confinement in the state penitentiary for a term of two years.
A brief summary of the voluminous record discloses the following facts: On December 6, 1924, defendant, in company with one Madison, one Emerson, and two women, left the town of Perry in a Nash automobile belonging to Madison, and drove south some 10 or 12 miles into Payne county.
