The plaintiff in error, hereinafter called defendant, was convicted in the district court of Oklahoma county on a charge of murder, and sentenced to life imprisonment. This is a companion case to that of Lowden Carle v. State, 21 Okla. Cr. 21, 221 P. 797, heretofore decided by this court
