The plaintiff in error, hereinafter called defendant, was convicted in the district court of Bryan county of manslaughter in the second degree, and was sentenced to serve a term of two years in the state penitentiary.

At the time charged, defendant upon the public highway at the approach to a bridge on Caddo creek drove an automobile against another automobile driven by one Sanders, and in which was the wife of Sanders and Earl O’Hara and wife. The collision occurred . in the early evening soon after dark. Defendant’s car struck the rear of Sanders’ car, pushing it over a bank some seventeen…
