The defendant was indicted for an assault and battery with intent to murder. The jury found him guilty of an assault and battery. Judgment on the verdict.
On the trial of the cause, the defendant’s counsel moved the Court to instruct the jury, “ that if after hearing all the evidence in the cause, there remained in their minds a rational doubt of the guilt of the defendant, they ought to find him not guilty.” The Court refused to give the charge as asked, but they instructed the jury, “that they must be satisfied beyond a rational doubt of the guilt of the defendant, before they could find him…
