This is a case of bastardy. The suit was instituted by the State, on the relation of Sarah Corbin, against Joseph Walker before a justice of the peace. The defendant pleaded not guilty. The justice tried the cause and rendered judgment for the defendant. The State appealed to the Circuit Court. The defendant moved theCourt to dismiss the appeal, but the motion was overruled. A writ was then issued in a cause, by order of the Court, to compel the defendant’s appearance, and he was arrested accordingly. The parties appeared and submitted the cause to a jury.
