The United States Magistrate Judge B. Waugh Crigler conducted evidentiary proceedings in accordance with an Order by this court to render a report setting forth appropriate findings, conclusions and recommendation on the plaintiffs petition for the award of attorneys’ fees under the Equal Access to Justice Act (“EAJA”).
