MEMORANDUM AND ORDER

LUNGSTRUM, District Judge.

Plaintiff Reginald Dockery on his own behalf and in his capacity, along with plaintiff Rebekah Dockery, as guardians of their minor son K.C.D., brought this lawsuit against defendants Unified School District No. 231 and Tim Yoho, the school district’s director of human resources, asserting various employment and racial discrimination claims. This matter is before the court on Defendants’ Motion to Dismiss Plaintiffs’ Second Amended Complaint (Doc. 42) and Plaintiffs’ Motion for Leave to File a Third Amended Complaint (Doc. 38).
