Over the years, ■ Defe'ndant Merial Ltd. has accordingly protected sales of its patented flea medicine from competitors via litigation and contractual agreements. Several of those agreements spawned the present dispute between Plaintiffs (Merial competitors) and Merial over whether and when Plaintiffs could sell competing flea products.
