KILEY, Circuit Judge.
This is a diversity suit to recover proceeds of an insurance policy covering loss by theft of plaintiff’s automobile. Verdict, and judgment for $7,612.02, were in plaintiff’s favor. He refused defendant’s check for that amount and the check was deposited with the clerk óf the trial court. Plaintiff has appealed.
