MEMORANDUM OPINION AND ORDER

McCALLA, District Judge.

Plaintiff, Warner L. Wagner, a white male police lieutenant employed by the City of Memphis, brings this suit under 42 U.S.C. § 1983 against the City of Memphis, Mayor W.W. Herenton, and Walter L. Winfrey, Director of Police Services, alleging violations of the due process and equal protection clauses of the Fourteenth Amendment to the United States Constitution.
