These are bills in equity respectively filed on July 1, 1958, and August 18, 1958, by Pieper, a landowner, (a) against the planning board (the board) of South-borough (the town), and (b) against the town clerk, with reference to a subdivision plan filed with the board by Pieper. The cases arise under the subdivision control law, G. L. c. 41, §§ 81K to 81GG, and were submitted to the trial judge upon a statement of agreed facts.
