— This case is presented here on the findings, conclusions and judgment of the trial court. Those findings that are essential in disposing of the case are substantially as follows: The First National Bank of Odessa commenced the foreclosure of a chattel mortgage by notice and sale through the sheriff’s office, against August Giese and wife. The sheriff took possession not only of all the chattels described in the mortgage, but of other chattels covered by mortgages due to persons other than the bank.
