Appellate Division of the Supreme Court of the State of New York

Decided March 14, 1988PublishedCited by 1 opinion

1Opinion of the Court

Appeal by the defendant from a judgment of the Supreme Court, Kings County (Broomer, J.), rendered January 21, 1983, convicting him of robbery in the second degree, criminal use of a firearm in the second degree and criminal possession of a weapon in the fourth degree, after a nonjury trial, and imposing sentence. The appeal brings up for review the denial, after a hearing, of the defendant’s motion to dismiss the indictment on the ground that he was denied a speedy trial.

Ordered that the judgment is affirmed.

We find that the defendant was not deprived of his statutory right to a speedy trial…
