The record discloses that in November, 1928, the defendant was engaged in drilling an oil well in Seminole county, Okla. Eor the purpose of generating steam to drill said well, the defendant was using three boilers; that on the night of November' 22, 1928, at about one o’clock in the morning, the plaintiff went upon the premises seeking employment and requested tlie man in charge of tlio bo'.ler house to give him permission to sleep in the boiler house the remainder of the night.
