1. Appellees by a verified complaint in the court below sued Jacob Wirrick, who after the trial, and after perfecting this appeal in the Supreme Court, died. On petition to the Supreme Court the appellants, as the heirs of said Wirrick, were susbstituted as parties appellant. Thereafter the last-named court transferred the case to this court, and from that action we may assume that the case should have been appealed to this court in the first instance.
