{¶ 1} This case is before the court on the defendant’s motion for a new trial. This ease arises out of a conviction for trespass. The facts are taken from the trial and record in this case.

{¶ 2} The defendant was charged with trespass for returning to the property at 1510 Newman Avenue, Lakewood, Ohio, after eviction. The case was called for trial on October 14, 2009. Due to an unforeseen family emergency, Thomas Wagner was appointed as acting judge in the absence of the incumbent undersigned judge. The defendant was present in court with counsel.
