Appeal from a judgment of the superior court for Thurs-ton county, Linn, J., entered January 30, 1904, upon the verdict of a jury rendered in favor of the plaintiff, in an action of replevin.

On the 16th day of November, 1894, John Miller Murphy and Eliza J. Murphy, his* wife, mortgaged to A. A. Phillips, trustee, certain real property in the city of Olympia, upon a portion of which was situate the Olympia theater, for the purpose of securing the payment of certain indebtedness due the Eirst National Bank of Olympia and others. On the 5th day of January, 1902, this mortgage was duly foreclosed, -and the mortgaged premises ordered sold by a judgment and decree of the superior court of Thurs-ton county.
