On April 17, 1905, Harriet M. Berry, as administratrix 'of her husband’s estate, brought her action against the defendants for damages for the alleged unlawful killing of her husbandry the defendants in a shooting affray which occurred June 3, 1903, -and William Roy Berry sued to recover damages for injuries he received in the same affair. Actions were also brought against the defendants by other persons for like damages. At this time criminal prosecutions for the murder of Daniel P.
