Plaintiffs Carlos and Patricia Cancio brought an action to recover damages allegedly caused by the negligence of defendant Thomas J. White while driving an automobile. On August 24, 1994, after a jury trial, the jury returned a verdict in favor of plaintiffs and judgment was entered on the verdict on August 29, 1994. On January 31, 1995, the trial court granted plaintiffs’ motion for a new trial on the issue of damages only. On December 12, 1995, the case was tried a second time before a jury.
