I. Introduction
On January 21, 2010, plaintiff Homa Natijehbashem (“plaintiff’) and her husband Sion Ouriel (“plaintiffs husband”)1 commenced this action against defendant United States of America (“defendant”) pursuant to the Federal Tort Claims Act (“FTCA”), 28 U.S.C. §§ 1346(b), 2671, et seq., seeking, inter alia, to recover damages for personal injuries she allegedly sustained as a result of a trip and fall over a purported defective condition existing on the public sidewalk adjacent to property *501leased by defendant.
