This is an appeal from a judgment of the Circuit Court of Shelby County confirming an arbitration award.

The record reveals the following: Maxus, Inc., d/b/a Maxus Construction Company ("Maxus") entered into a written cost-plus contract dated May 11, 1988, with Robert and Roseann Sciacca for the construction of a residence for the Sciaccas.
