Respondent, Prank H. Dwyer, had, by appointment of the board of county commissioners of Beadle county, filled the position of county highway superintendent of *351said county for the years 1921 and 1922, and by action of the county commissioners of said county on December 5, 1922, was again appointed to such position for a period of two' years to begin January 1, 1923. On the 6th day of March, 1923, the board of county commissioners of Beadle county passed the following resoultion:
