KIDWELL, J.
In this action the parents and personal representatives of two sisters, who were killed in the collision of two automobiles, sought damages from the appellee (City) and others not parties to this appeal. At the close of a jury trial, a directed verdict and judgment was entered for the City and plaintiffs appeal. The appeal presents the question whether the intoxication of one of the drivers and his alleged excessive speed, as a matter of law, insulated the City from liability predicated on its defective maintenance of the highway shoulder.
