This case was brought before the court by the plaintiff, John Joseph Caldwell, (“Caldwell”), against Deputy Sheriff Jeff A. Green, (“Green”), and Sheriff Bobby G. Hammons, (“Hammons”), of Dickenson County, Virginia, for alleged violations of 42 U.S.C. §§ 1983, 1986 and 1988. The plaintiff also alleges state law tort claims for battery, false arrest, false imprisonment, negligent infliction of emotional distress and malicious prosecution.
