On the twenty-fourth day of March, 1927, B. Y. Duke, hereinafter called plaintiff, filed his complaint in the superior court of Apache county, ag’ainst Mrs. John H. Porter, hereinafter called defendant, for damages alleged to have been received by plaintiff through the negligent driving of an automobile owned by defendant. A writ of attachment was sued out on the same day, but was never served, and was quashed on motion of plaintiff on the first day of April.
