Petitioner, a state prisoner, brings this action for a writ of habeas corpus pursuant to 28 U.S.C. § 2254. This matter is before the Court on the instant petition, respondent’s return of writ and the exhibits of the parties.

Petitioner and five other defendants were indicted by the October 1995 term of the Pickaway County grand jury on one count of engaging in a pattern of corrupt activity, in violation of O.R.C. § 2923.32(A)(1), twenty-six counts of receiving stolen property, in violation of O.R.C. § 2913.51, four counts of theft, in violation…
