The plaintiff in error, hereinafter called defendant, was convicted in the county court of Choctaw county of having the unlawful possession of intoxicating liquor, and was sentenced to pay a fine of $50, and to serve 30 days in the county jail.

An examination of the record discloses that the evidence sufficiently sustains the judgment. A statement of facts is deemed unnecessary.

It is urged at length that the court erred in overruling defendant’s motion to dismiss the prosecution for the reason that defendant was not brought to1 tidal at the next term of court after which the information was…
