Ben Dew, plaintiff in error, was prosecuted by indictment returned by the grand jury into the district court of Tulsa county and transferred to the county court of said county, wherein it was charged that on the 2nd day of December, 1913, Ben Dew did unlawfully have in his possession one hundred eight quarts of whisky, one hundred twelve quarts of gin, and one hundred fifty pints of beer, with intent then and there to sell, barter, give away and otherwise furnish the same in violation of the prohibitory liquor law.
