The action in this case was brought August 27, 1920, by Gus Mueller, as plaintiff, against John W. Teer and Lena L. Teer, as defendants, to recover damages for personal injuries sustained by him while walking across Main street in Ardmore, in being struck by defendant’s automobile. The parties will be referred to as they appeared in the trial court.

The petition states that the plaintiff is a man about 70 years of age, of reasonable health and capable of earning $8 per day; that he was crossing Main street in Ardmore, north, opposite the Whittington hotel and, while…
