¶ 1. CHIEF JUSTICE. This is a review of an unpublished decision of the court of appeals1 affirming a judgment of the Circuit Court for Oneida County, Robert E. Kinney, Circuit Court Judge. The circuit court granted summary judgment in favor of the State, holding that *781defendants John W. Kelley and Peter M. Kelley had violated Wis. Stat. §§ 30.12(1)(a), 30.15(1)(a), and 30.15(1)(d) (1997 — 98)2 by depositing fill on a 200-foot section of land submerged at times by Lake Killarney, a navigable water, without a permit.
